Terms and conditions of delivery and of payment of beachcruiser.de
§ 1 Ambit:
For business relations between beachcruiser.de and the orderer valid only the following general terms and conditions in its relevant version at the time of the order. Deviating applications of the orderer aren't accepted by beachcruiser.de, unless beachcruiser.de expressly consented in wrítten form.
§ 2 Conclusion of the contract:
All types of offers are always subject to change and without obligation, unless they are expressly referred to as binding offer in written form by beachcruiser.de. Subject to availability. We reserve the right to send an equal product in case of unavailability. Then you will be informed immediately. All orders are not binding untill they are writtenly or by delivery with issuing an invoice confirmed.
§ 3 Delivery and shipping:
beachcruiser.de is always keen to meet the stated delivery date. They are without obligation. The delivery usualy takes 3-4 workingdays, bikes with accessory equipment takes untill 14 workingdays. The delivery takes place on account of the orderer, as far as nothing else is concerted. In the event of delay you will be informed by e-mail about the approximate delivery date.
Delivery abroad:
The shipping and handling charge acts in accordance with the country of destination and is calcuated before the order. The orderer itself is responsible for the clearing formalities.
§ 4 Agreements of condition:
Goods of the contract description result solely from the manufacturers' instructions in the operating manual. Variations need a written agreement.
§ 5 Prices, maturity and payment:
The calcuation of prices for the ultimate consumer is effected, unless otherwise expressly agreed, by at the current daily price of purchase order date. Pricings are final prices in euro and include the VAT. VAT is subtracted by shipping outside europe. Accounts of beachcruiser.de are due immediately without deductions settle, unless anothe rpayment date is denoted on the bill.
Please note that possible bank charges have to be accepted, so that the complete amount achieves us.
Financing (only in Germany):
Installment after concluing the financed treaty.
§ 6 Liability and guarantee:
The customer is responsible for inspection and investigation. beachcruiser.de is not liable for resulting damages by reason of unexamined relayed products also not for applicability of suplied products for the intended purpose or disadvantages that may result by using or processing.The statute if limitation of liability for defects is running for 2 years. Our delivered bikes are mail-order compatible pre-assembled. beachcruiser.de assumes no responsibility for final assembly. beachcruiser.de confines the liability in legally allowed cases to the delivery item and is not liable for damages that didn't arise to the delivery item.
§ 7 Returns and money back guarantee:
The contract of purchase can be canceled within 14 days after the order has been received. Therefor the products needs to be sent with the notation "return" to the above-mentioned adress. The packet needs to be stamped. Unstamped returns won't be accepted. Stating the reason is unnecessary. We take the responsibility for back shipping. We accept the responsibility for the reconsignment. The cancellation, exchange or return of customized products is not permitted. Including for instance modular construction system as well as bikes with optional feature.
§ 8 Return cosequences:
The contract of purchase is rescinded after return or retraction of the product and we repay made payments within 30 days by remittance. The costumer
must pay the costs of depreciations except for those that result from checking of products. In order to avoid depreciations please don't use it as an owner.
§ 9 Effectiveness of the provisions of contract:
The vality of these terms and conditions won't be influenced
by nullity of one or several terms.
§ 10 Applied law:
For all buisness relations applies German law.
